To ask the Minister of Agriculture, Fisheries and Food if he will review the implementation of the Food Safety Act 1990 with reference to the selling of out-of-date food in the retail trade.

No Sir. It is already an offence under the Food Labelling Regulations 1984 for anyone to sell food bearing an expired "use by" date.

It is also an offence under the Food Safety Act 1990 to sell any food which is unfit for human consumption or which is not of the nature, substance or quality demanded by the purchaser, whether or not any date mark has expired.
