To ask the Chancellor of the Duchy of Lancaster if he will make a statement on the impact of recent European Court decisions on the future of market testing and compulsory competitive tendering, within the civil service.

There is nothing new in this. The fact is that both the Transfer of Undertakings (Protection of Employment) Regulations 1981, and the Acquired Rights Directive which they implement in United Kingdom law, can already apply to transfers from the public to the private sector; and this has always been the case.

We are continuing with our programme to open services to competition across the public sector and advice will be taken on individual cases as necessary.
