asked Her Majesty's Government:

In what proportion of cases where defendants are remanded in custody and subsequently convicted but not received into prison under sentence are defendants (a) given non-custodial or suspended sentences and (b) given immediate custodial sentences which are not served because of time spent on remand in custody.

According to the records held centrally, which are approximate, the information requested for untried or convicted unsentenced prisoners initially received in 1991 into Prison Service establishments in England and Wales is provisionally as follows:

Ninety-three per cent. of those who were convicted, but who were not subsequently received under sentence and whose court disposal was known, received a non-custodial sentence. The remaining 7 per cent. were freed on the rising of the court, having been sentenced to immediate custody of such length that it had already been served on remand.
