To ask the Secretary of State for Health whether she will give every citizen the right of access in the patients charter to medical records held about him or herself by(a) an employer and (b) by a medical practitioner.

The Access to Health Records Act 1990 and the Data Protection Act 1984 provide individuals with a right of access to their own health records, subject to certain safeguards. This right has been highlighted in the patients charter. The statutory right of access extends to those health records held by an individual's employer where those records have been compiled by a health professional in connection with the individual's care.
