asked Her Majesty's Government:

Whether it is to be inferred from their Answer of 16th July 1990 (H.L. Deb., col. 742) about the genetically engineered hormone BST, that it would be open to a manufacturer to plead that his liability under the Medicines Act had been voided because the Minister had licensed the product on the grounds that it met "the criteria of safety, quality and efficacy" required by the Veterinary Products Committee.

I do not consider that a manufacturer's liability under Part I of the Consumer Protection Act 1987 would be voided by the issue of a licence under the Medicines Act 1968, although this would ultimately be a matter for the court itself to decide.
