To ask the Secretary of State for Education and Science what action is being taken by his Department to ensure that local education authorities are assessing all children in their areas with special educational needs and are issuing formal statements describing their specific requirements.

Mr. Fallon

It is for LEAs to decide on the provision to be made for children in their areas with special educational needs. Parents have rights of appeal and complaint under the Education Act 1981 and the Education Act 1944 respectively. These provide safeguards against any avoidance by LEAs of their statutory obligations.
