asked Her Majesty's Government:

What action they intend to take with regard to the case of Mr. Michael Thyne in the light of the judgment of the European Court of Human Rights delivered on the 25th October 1990.

The court's judgment, which found a breach of Article 5, paragraph 4 of the European Convention on Human Rights in Mr. Thynne's case, indicated that there was no evidence that he would have regained his freedom had processes complying with the convention been available to him. Under existing United Kingdom law, the judgment does not affect the arrangements for the review of Mr. Thynne's case. It will be referred in February 1992 to the local review committee at the prison where he is then detained as the first stage of a further review by the Parole Board.
