HC Deb 26 February 1991 vol 186 cc418-9W
Sir Michael McNair-Wilson

To ask the Secretary of State for the Environment what is the legal status of building regulations; and what legal penalties exist for local authority personnel who do not carry them out properly.

Sir George Young

Building regulations impose legally binding requirements relating to the design and construction of buildings. A person who is carrying out building work is under a duty to comply with these requirements, and a person who contravenes them can be prosecuted and fined. While local authorities have the function of enforcing the regulations in their areas, any failure to do so does not give rise to legal penalties, although other sanctions against the authority and its personnel may be available.
