asked Her Majesty's Government:

Following their confirmation that they intend to seek the powers of derogation under EC Directive No. 89/369/EEC (New Plant) in favour of Refuse Derived Fuel (RDF), whether they will confirm that they intend to use these powers and whether they will list all of the derogations agreements they will be seeking and how each will affect the development of RDF.

The Department of the Environment is preparing regulations to implement the EC directive on municipal waste incineration (89/369/EEC) which will include powers to derogate for plant burning refuse derived fuels. Combustion plant burning RDF will be subject to control under Part 1 of the Environmental Protection Act 1990. Guidance, which will address the question of derogation, will be issued for consultation in due course.
