To ask the Secretary of State for Social Security if he intends to recommend changes to regulation 25(2) of the Social Security (Industrial Injuries) (Prescribed Diseases) Regulations 1985 (SI No. 967) in view of the Court of Appeal decision in the case of McKiernonv. the Secretary of State for Social Security in 1989 affecting claims for industrial deafness which are more than five years old; and if he will make a statement.

No. The legality of regulation 25 of the Social Security (Industrial Injuries) (Prescribed Diseases) Regulations 1985 has been put beyond doubt by the provisions in paragraph 4(3) of schedule 6 to the Social Security Act 1990.
