To ask the Secretary of State for Employment if he will list the offences which may be committed by companies concerning the health and safety of employees, in each case specifying the notices which may be served on companies which fail to comply with statutory provisions.

The offences for which the Health and Safety Executive (HSE) and its agents are responsible are listed in sections 33(1), 36 and 37 of the Health and Safety at Work etc. Act 1974—the HSW Act—and breaches of the relevant statutory provisions, listed in schedule 1 of the HSW Act, and regulations made under them. If an inspector is of the opinion that an offence has been committed under any of this legislation, he may issue a prohibition or improvement notice in accordance with sections 21 and 22 of the HSW Act.
