HL Deb 25 July 1990 vol 521 c1602WA
Lord Kennet

asked Her Majesty's Government:

Whether they are content that all insurance companies, reinsurance companies, and protection and indemnity clubs endorse, and regularly apply the doctrine of uberrimae fidei, and if, in their opinion, they do not, will they require them in future to do so, so that insurance cover is no longer available to parties which do not properly observe all the safety measures they should.

Lord Hesketh

The principle ofuherrimae fidei applies to all insurance contracts governed by English law. Whether a contract of insurance will be voidable through non-observance of safety regulations is likely to depend, subject to any overriding considerations of public policy and illegality as applied to the courts, on the terms of the contract and the circumstances of the case.
