§ Ms. WalleyTo ask the Secretary of State for the Environment if he will make a statement on part II of the Environmental Protection Bill concerning the division of responsibilities between Her Majesty's inspectorate of pollution and the waste regulatory authorities for the enforcement of(a) the special waste regulations and (b) the transfrontier shipment of hazardous waste regulations with regard to waste disposal facilities subject to integrated pollution control and those not subject to integrated pollution control.
§ Mr. TrippierIn January 1990 we published a consultation paper reviewing the Control of Pollution (Special Waste) Regulations 1980 and setting out the changes which we propose to make to the present arrangements. It is proposed that waste regulation authorities should continue to be responsible for the enforcemet of the revised special waste regulations which will be made in due course under part II of the Environmental Protection Bill, including those cases where special waste is consigned to a process authorised for control by HMIP under part I of the Bill. In such cases, it is proposed that waste regulation authorities should have access to and should be provided with the information necessary for them to discharge their responsibilities under the special waste regulations.
The Transfrontier Shipment of Hazardous Waste Regulations 1988 implement directive 84/631/EEC. This directive is at present being reviewed by the European Commission in the light of the Basel convention on transboundary movements of hazardous waste. It is anticipated that the Commission may propose a regulation to replace directive 84/631/EEC. A decision on the continuing responsibilities of waste regulation authorities under the 1988 regulations will be taken in the lightof the regulation adopted by the Community.
