To ask the Secretary of State for Employment to what extent storage of pesticides is subject to the Control of Industrial Major Accident Hazards Regulations 1984; and if he will make a statement.

Pesticides within the scope of the Control of Industrial Major Accident Hazards (CIMAH) Regulations 1984 are those which:

  1. (i) are listed in schedule 2 to the regulations and are kept in isolated storage above specified threshold quantities; or
  2. (ii) meet the indicative criteria set out in schedule 1, or are listed in schedule 3 and are kept in quantities above specified thresholds, where the storage is associated with a process operation subject to the regulations.

An amendment to the CIMAH regulations is currently in preparation in order to implement the second amending directive (88/610/EEC) to the "Seveso" directive (82/501/ EEC). This will broaden the scope of CIMAH so that among other things it will have greater application to the storage of pesticides.
