§ Mr. FraserTo ask the Attorney-General whether, in the light of the case of Board v Checkland (1987) 17 Family Law 236, he will introduce legislation to validate orders made in matrimonial proceedings where in error the order for a lump sum or transfer of property pre-dates the date of the decree nisi.
§ The Attorney-GeneralNo. The provisions of section 23 of the Matrimonial Causes Act 1973 are satisfactory and necessary. The invalidity of the order in the case of Board v Checkland was the result of a failure to comply with those provisions.
