To ask the Secretary of State for Northern Ireland if he will take steps to prevent private developers building outside the areas for which they have provided bonds.

Mr. Needham

Under the terms of article 24 of the Private Streets (NI) Order 1980 it is an offence if a developer starts building work prior to the provision of a bond in respect of the related street works. Enforcement action may be deferred from time to time on the basis of an assurance by the developer that a bond will be obtained. However, where developers fail to provide the necessary bond, prosecution proceedings are taken.

To ask the Secretary of State for Northern Ireland if, where the Department of Environment has allowed housing development to take place without a bond from the developer in respect of street works, it accepts responsibility for making good the necessary street works when a liquidation or bankruptcy occurs.

Mr. Needham

Where housing development has taken place without a bond as required by the Private Streets (N.I.) Order 1980 the owners of the premises fronting the street are responsible for the related street works in accordance with article 36 of the order.
