Mr. Spearing

To ask the Secretary of State for Foreign and Commonwealth Affairs if he will list those areas of legislative initiative that remain freely available to Her Majesty's Government and which do not lie within the originating competence of the Commission of the European Economic Communities.

Mr. Waldegrave

The member states retain national legislative competence in those areas where the Community does not have exclusive competence under the EEC treaty or instruments adopted under it, for example, in areas such as criminal law, family law, rules on the ownership of property. It would not be practicable to compile an exhaustive list in the form required.
