Mr. Mallon

To ask the Secretary of State for Northern Ireland if, in circumstances where an abandonment notice has been served on land and property owners in relation to the proposed abandonment of a road, a clear statement of the relevant procedures has been issued to each land and property owner; and if he will publish this notice of procedures in theOfficial Report.

Mr. Needham

[holding answer 31 October 1988]: There is no statutory requirement for the Department of Environment for Northern Ireland to serve notice of its intention to abandon a road on land or property owners, but it is required to publish such a notice in the local press. However, in addition to fulfilling this statutory requirement, departmental officials consult land and property owners on an informal basis prior to the publication of the notice and advise them of their statutory rights of objection.
