Whether the consent of the Charity Commissioners will be necessary before the Secretary of State modifies the trust deed of any voluntary school without the prior consent of the trustees, when that school is seeking grant-aided status (particularly in cases where the school is held in trust for the benefit of the whole Catholic community, whether diocesan or national).
§ The Parliamentary Under-Secretary of State, Department of Education and Science (Baroness Hooper)The Education Reform Bill as amended in Committee makes it clear that the Secretary of State will consult the trustees before modifying any voluntary school's trust deed. The Charity Commissioners' consent would not be required.
