HC Deb 08 March 1988 vol 129 c172W
94. Mr. Ashley

To ask the Secretary of State for Social Services if he will initiate discussions with the Association of British Pharmaceutical Industries regarding the establishment of a no-fault drug damage compensation scheme.

Mr. Newton

We have no plans to do so. The Government have already introduced changes, which took effect from 1 March 1988 through the Consumer Protection Act 1987, to remove the need for an individual to prove negligence in establishing liability where it can he shown that a defective medicinal product caused personal injury. It must be for the pharmaceutical industry to decide whether it wishes to set up its own no-fault drug compensation scheme.
