To ask the Secretary of State for Employment whether the Health and Safety Executive has yet reached a decision on prosecution of the owners of Hantergantic quarry, St. Bernard arising from the accident occurring on 25 August 1987; and what is the average period of time taken by the executive to reach such decisions.

No. The Health and Safety Executive has taken action to seek counsel's opinion on this case. I will write and advise the hon. Member when a decision has been reached. The time taken to reach a decision varies and depends on the facts and features of each individual case.
