In considering whether the proposed acquisition of Rowntree plc by Nestlé should be referred to the Monopolies and Mergers Commission, both the Director General of Fair Trading in submitting his advice and the Secretary of State for Trade and Industry in making his decision took into account all relevant aspects of the case.
