(2) when he proposes to introduce regulations under section 31(4) of the Control of Pollution Act 1974 to control the construction of new or extended silage and slurry facilities, as outlined in paragraph 3.11 of "Observations by the Government on the Third Report of the Environment Committee on the Pollution of Rivers and Estuaries".
