asked Her Majesty's Government:

What arrangements have been made for the consideration of whether Scottish civil court procedures should be amended to provide for class or similar actions where a number of people have similar complaints against a common defender.

The Scottish Law Commission has agreed to accept a formal reference from me, under Section 3(1)(e) of the Law Commissions Act 1965, in the following terms:

  1. "(a) To consider the desirability and feasibility of introducing in Scottish civil court proceedings arrangements to provide a more effective remedy in situations where a number of persons have the same or similar rights;
  2. (b) to consider how such arrangements might be funded; and
  3. (c) to make recommendations".
