Mr. Sedgemore

To ask the Secretary of State for the Home Department if he will instruct the Commissioner of Police of the Metropolis to waive privilege in respect of the Cass inquiry documents covering the Blair Peach case and allow solicitors acting for Mr. Peach's family to release to the public their contents.

Mr. Douglas Hogg

I understand that the Commissioner of Police of the Metropolis regards the use of the documents supplied in the Blair Peach case for purposes outside those for which they have been disclosed on discovery as a matter for the courts.

Mr. Sedgemore

To ask the Secretary of State for the Home Department if the documents of the Cass inquiry concerning the Blair Peach case identify or help to identify any person involved in the killing of Blair Peach.

The Director of Public Prosecutions considered the report of the investigation into the circumstances surrounding the death of Mr. Peach and decided that the available evidence was insufficient to justify any criminal proceedings against any officer.

To ask the Secretary of State for the Home Department if he will call for a report from the Commissioner of Police of the Metropolis as to why he refused consent to hearings in the Blair Peach litigation taking place in open court.

I understand from the Commissioner of Police of the Metropolis that the plaintiffs appealed against an order to give security for costs and applied for the appeal to be heard in open court. The judge in chambers decided that it was not appropriate to hear the appeal relating to security of costs in open court. Counsel for the Metropolitan police opposed the application on the grounds that publication of the matters which would be raised might prejudice a fair hearing of the later trial for which a date had been fixed.
