To ask the Secretary of State for the Home Department why the consular section of the British embassy in Manila had not received instructions to issue a visa to Mr. Ronald J. Garcia as of 27 January, despite his having had his appeal against refusal of a visa allowed by the tribunal at Southampton on 6 September 1987; and when such instructions will be issued to the British embassy in Manila.

On 30 November a copy of the adjudicator's determination was sent to the British embassy in Manila. In accordance with normal practice where a visit visa is refused and the applicant's appeal is subsequently upheld, but no direction is given by the adjudicator, I would expect Mr. Garcia to be invited for interview to have his case reconsidered in the light of current circumstances. We have been in touch with Manila in the light of the hon. Member's representations and the entry clearance officer will certainly bear in mind the adjudicator's careful determination.
