To ask the Attorney-General what is the policy of the Crown Prosecution Service concerning the institution of prosecutions against police officers(a) in cases where criminal charges against others are subsequently dropped and damages are awarded against the police and (b) in cases where a defendant is acquitted and subsequently brings an action for wrongful arrest, false imprisonment or malicious prosecution and is awarded damages against the police.

The policy of the Crown Prosecution Service concerning the institution of criminal proceedings against police officers follows the criteria contained in the code for crown prosecutors, issued under Section 10 of the Prosecution of Offences Act 1985. Staleness occasioned by the time occupied by earlier court proceedings may acquire particular significance.
