asked the Secretary of State for the Environment if he will amend paragraphs 40 and 41 of his circular 28/77 so as to exclude those local authorities which have a designation order under the Caravan Sites Act and which have provided the required number of pitches from the requirement to adopt a sympathetic and flexible approach to planning applications from gipsies.

No. In planning cases where the need for gipsy sites is a material consideration my right hon. Friend and his inspectors will have regard to the existence of any designation order and to all other relevant matters when deciding what weight to attach to the paragraphs of the circular to which my hon. Friend refers.
