§ Mr. DalyellTo ask the Attorney-General what criteria are used in deciding whether to bring an action for account of profits against an author or publisher alleged to be in breach of a duty of confidence owed to the Crown; and on how many occasions such an action has been brought since 1979.
§ The Attorney-GeneralThe Crown will claim the remedy of an account of profits in a breach of confidence action whenever appropriate to ensure that the defendant does not profit from his breach. Such a claim has been brought in six cases since 1979, injunctions also being sought.
