Mr. Cohen

asked the Secretary of State for Defence what is his Department's policy towards fees for subject access under the terms of the Data Protection Act; how many registered entries his Department has; and what would be the total cost to a data subject seeking access to personal data held under all register entries.

Mr. Sainsbury

The Department's policy towards fees for subject access under the Data Protection Act 1984 is that there will be no charge for current, past and potential MOD employees but for other data subjects the statutory fee of £10 will be charged. The MOD has six register entries covering a total of 16 purposes. The total cost to a data subject, who is not a current, past or potential MOD employee, seeking access to personal data held under all registrations would be £60.
