asked the Secretary of State for Transport what is his policy towards building roads over disused canals; and if he will make a statement.

Each case is considered on its merits. The statutory position is that if a canal although disused is still classed as a navigable waterway, special procedures have to be complied with. If there are no navigable rights, the usual procedures for building roads and acquiring land apply.
