asked Her Majesty's Government:

What arrangements have been made for detailed consideration of the implications for Scotland of the possible implementation of the patent litigation proposals made in the White Paper on Intellectual Property and Innovation.

The Lord Advocate (Lord Cameron of Lochbroom)

Following consideration of the Scottish representations received by the Secretary of State for Trade and Industry on the proposals in the White Paper, I have had discussions with him and with the Lord President of the Court of Session. The Lord President has now set up a Working Party, chaired by the Hon. Lord Jauncey, which will considersuitable Scottish alternatives to the White Paper proposals and, in particular, what changes, if any, might he desirable in the Rules of the Court of Session".

The other members of the Working Party are:

Mr. Nigel Emslie, QC, nominated by the Faculty of Advocates;

Mr. I G Inglis, WS, nominated by the Law Society of Scotland;

Mr. J W Arthur, Fitzpatricks, Chartered Patent Agents;

Mr. John Davidson, Director (Scotland) CBI;

Mr. Peter Britton, nominated by the Department of Trade and Industry;

Mr. R Bland, nominated by the Scottish Courts Administration;

Mr. Nigel Morrison, Junior Counsel to the Lord President;

Mr. M Weir, nominated by the Principal Clerk of Session and Justiciary;

Mr. Weir will also as act as Secretary to the Working Party.
