Where the Secretary of State or the adjudication officer wishes to appeal against the decision of a social security tribunal or a medical appeal tribunal the claimant is advised in writing that an appeal to the commissioner is to be made or, where appropriate, that leave to appeal to the commissioner is being sought from the tribunal chairman.
