Mr. Dalyell

asked the Secretary of State for Defence what action he proposes to pursue in the light of the decision by Mildenhall magistrates to declare unlawful 27 byelaws made by his Department in relation to the United States air force base at Mildenhall; and if he will make a statement.

Mr. Freeman

The decision of the Mildenhall magistrates has been referred by the Director of Public Prosecutions to the Divisional Court for a ruling,. I am not in a position to make further comment.

Mr. Dalyell

asked the Secretary of State for Defence what assessment he has made of the implications for the byelaws applying to other military bases in the United Kingdom, of the decision by Mildenhall magistrates to declare unlawful 27 byelaws made by his Department in relation to Mildenhall United States air force base; and if he will make a statement.

Mr. Freeman

The Ministry of Defence police will continue to take action under the byelaws at Mildenhall and other bases where there are similar byelaws.
