HC Deb 20 March 1986 vol 94 c265W
Mr. Fry

asked the Secretary of State for Trade and Industry if he will make a statement regarding the effects of the material changes proposed to be made by the Association of British Travel Agents to the stabiliser agreement as upheld by the Restrictive Practices Court in December 1983 Case: 1978 No. 13 (E & W).

Mr. Howard

Under the Restrictive Trade Practices Act, it is the responsibility of the Director General of Fair Trading to refer certain agreements to the Restrictive Practices Court for a judgment as to whether the restrictions on those agreements are contrary to the public interest. If, subsequently, the Director-General of Fair Trading obtains prima facie evidence of a material change in the circumstances on which the court's decision was based, he has powers to seek leave to apply for to the court for a variation of its decision.
