asked the Secretary of State for the Home Department what is his policy in relation to the circumstances in which he orders the removal of people whose entry to the United Kingdom was subject to immigration control, who have been in the United Kingdom for 10 years or more but whose residence during that period has been lawful.

Mr. Waddington

Continuous lawful residence in the United Kingdom of 10 years or more is considered a prima facie reason for allowing a person to remain even though he or she does not qualify to do so under the general provisions of the immigration rules. However, each case is considered on its merits taking into account any countervailing factors such as a criminal record.

In considering possible deportation, my right hon. Friend has regard to the matters set out in paragraphs 156–159 of the immigration rules (HC 169).
