Mr. Adley

asked the Secretary of State for the Environment if he will list for each local authority in England the total amount of rate relief granted under the Government's obligations to provide reimbursement of 90 per cent. of such relief to (a) registered nursing homes and (b) registered rest homes.

Information is not available for particular types of premises receiving rate relief under the Rating (Disabled Persons) Act 1978. Figures are given for the amount of relief for all institutions, and the amount reimbursed to the local authority by my Department, for each local rating authority in England for the latest available year, 1984–85. In some cases the figures are still subject to audit.

asked the Secretary of State for the Environment if he will make a statement on the working of the Rating (Disabled Persons) Act 1978 in so far as it relates to the relief from rates of registered nursing homes and registered rest homes.

The Rating (Disabled Persons) Act 1978 was amended by the Rates Act 1984. As amended, section 2 provides for full or partial rate relief for institutions accepted by the local rating authority as being used wholly or predominantly for specified purposes, mainly the accommodation or employment of ill or disabled people.

Nursing homes, rest homes and similar premises fall within the scope of the relief when they are used wholly or predominantly to provide residential nursing and domestic care for people who are or have been suffering from illness or who are disabled, but not if their clients are there solely because of factors such as age, being otherwise fit. No distinction is drawn between public sector and private sector institutions. Last year, my right hon. Friend the Secretary of State for Social Services strengthened the regulatory and inspection procedures for such institutions under the provisions of the Registered Homes Act 1984.

To minimise the effect on local resources, particularly in areas where such premises are concentrated, my Department reimburses to local authorities 90 per cent. of the amount of the relief. The remaining 10 per cent. is taken into account when block grant entitlement is calculated.

Mr. Adley

asked the Secretary of State for the Environment what information he has as to how many cases relating to the Rating (Disabled Persons) Act 1978 have been heard in the High Court since the Act came into operation; and what effect the outcome of these cases has had on the working of the legislation.

I am aware of six cases. Only two of them have affected the operation of the Act: Morganv. Windsor and Maidenhead Royal Borough Council and Glenherne Nursing Services Ltd. v. Same, heard together in 1981. The judgment clarified the meanings of "care" and "illness" defined in section 2 of the Act in such a way as to bring within its scope premises providing for those who, as a result of illness or disability, could no longer live at home. A number of local authority and privately-run institutions which had previously been thought not be eligible have since successfully applied for relief.
