asked Her Majesty's Government:

Whether their proposal that handlers of waste should have to register with each waste disposal authority in which they have an operating centre (H.L. Debates, 11th December 1985, col. 339) will include any sanctions against handlers of waste who have committed environmental offences in connection with waste disposal.

It is not envisaged in this proposal that any sanction other than that imposed by the court would be applied to a registered waste handler who commits an offence under the Control of Pollution Act 1974. Details of the offence would, however, be noted on the register and would thus be available to any producer considering employing that particular handler's services.

The Government have, however, also proposed that transport licensing authorities should be empowered to take such offences into account when considering whether to grant or renew a road haulier's operator's licence.
