Whether they are planning to update Circular 36/78 (Trees and Forestry) and in so doing to define a tree, as the circular has been criticised in two High Court judgments for having no definition.
§ Lord SkelmersdaleWe hope to update and revise Circular 36/78, now out of print, as soon as staff resources permit. In doing so we shall consider whether the term "tree" can be given a legal definition.
