asked the Secretary of State for Scotland if he will call in the planning approval for Shanks and McEwan which allows the dumping of asbestos at Glenboig prior to holding a public inquiry; and if he will make a statement.

Modification of planning permission or of licences to dispose of waste issued under the Control of Pollution Act 1974 are matters for the planning authority and the waste disposal authority respectively. In this case, Monklands district council is both the planning authority and the waste disposal authority. Under planning legislation, the Secretary of State has no "call in" power once planning permission has been granted and there is no "call in" provision under the Control of Pollution Act 1974. Where an authority proposes to revoke or modify planning permission or a site licence, the holder has a right to have the matter brought before the Secretary of State for determination.
