§ Mr. WaldegraveNo. Under section 193(1) of the Law of Property Act 1925 the public have a legal right of access, for air and exercise, to the areas of common land at Maltby Far and Low Commons, by virtue of their location in an urban district on 1 January 1926. In these circumstances it would not be appropriate for a deed to be deposited under subsection (2).
