asked the Secretary of State for Social Services whether special arrangements have been made to deal with claims for invalid care allowance by married and cohabiting women since invalid care allowance was awarded to Mrs. Drake on 1 March; and if he will make a statement.

The case of Mrs. Jaqueline Drake was referred to the Social Security commissioner for decision. The commissioner has put to the European Court the question whether the EC directive on equal treatment in social security matters applies to invalid care allowance. Until the court gives its judgment and the Social Security Commissioner makes his decision in Mrs. Drake's case, any other claims from married or cohabiting women for invalid care allowance are being stored to be adjudicated once the outcome of Mrs. Drake's case is known. A letter explaining the position is sent acknowledging all such claims.
