HC Deb 31 October 1984 vol 65 c974W
Mr. Robert C.Brown

asked the Attorney-General what is the reason for the delay in implementing section 6 of the Administration of Justice Act 1982; and if he will give an undertaking that he will now speed up the process.

Mr. McGuire

asked the Attorney-General when Her Majesty's Government expect to bring into operation section 6 of the Administration of Justice Act 1982.

The Attorney-General

Section 6 of the Administration of Justice Act 1982 left a considerable amount of detail regarding provisional awards of damages in personal injury actions to be settled by rules of court. A consultative paper canvassing options as to what the rules should provide was issued by the Lord Chancellor's Department in April 1983. This produced such a wide divergance of views that it was necessary for a second paper to be prepared. That paper was issued on 20 September 1984 with a deadline for replies of 31 October. The results of this second consultation will be considered urgently.
