asked the Secretary of State for the Home Department if, in the light of the recent High Court decision, he has any plans to introduce legislation to amend the Transport Act 1981 in respect of convictions for refusing breath tests.

I have been asked to reply.

I shall be studying the details of the case referred to by my hon. Friend. All I would say at this stage is that failure without reasonable cause to provide a specimen of breath for a breath test has been an offence since the implementation of the Road Safety Act 1967. An offence of this nature is clearly essential for the effective operation of the law in respect of drinking and driving.
