§ Mr. Colvinasked the Secretary of State for the Home Department what criteria licensing magistrates take into account when granting occasional licences under the Licensing (Occasional Permissions) Act 1983.
§ Mr. MellorSection 1(2) of the Licensing (Occasional Permissions) Act 1983 requires the licensing justices to be satisfied that, when granting an occasional permission to an officer of an organisation which is not carried on for private gain, or a branch of such an organisation:
- (a) the officer is a fit and proper person to sell intoxicating liquor and is resident in their licensing district;
- (b) the place where the function is to be held is suitable for the sale of intoxicating liquor and is situated in that district; and
- (c) the sale of intoxicating liquor at the function is not likely to result in disturbance or annoyance being caused to residents in the neighbourhood of the place, or in any disorderly conduct.
