Mr. Carter-Jones

asked the Secretary of State for Foreign and Commonwealth Affairs what representations he has made to the European Economic Commission regarding the treatment received by Mr. Stanley Adams, late of Hoffman La Roche; what investigations the European Economic Community has made into his treatment by its officials as a result of his efforts to co-operate with the European Economic Community; and if he will make a statement.

Mr. Adams is a Maltese citizen. We therefore have no direct locus to intervene with the Commission, although our permanent representation in Brussels has in the past discussed the case informally with it. The Commission made an ex gratia payment of £25,000 to Mr. Adams on 29 May 1980. Mr. Adams is now bringing a case against the Commission before the European Court, alleging breach of non-contractual obligations. Notice of the case was given in theOfficial Journal of the European Communities on 13 August 1983. It is likely to come before the European Court later this year.
