HC Deb 18 December 1984 vol 70 cc100-1W
Mr. Patrick McNair-Wilson

asked the Secretary of State for Defence if he is satisfied with the operation of section 10 of the Crown Proceedings Act 1947.

Mr. Lee

Section 10 of the Crown Proceedings Act 1947 is currently under review.

Mr. Patrick McNair-Wilson

asked the Secretary of State for Defence on how many occasions since 1947 section 10 of the Crown Protection Act 1947 has been invoked.

Mr. Lee

Section 10 of the Crown Protection Act 1947 applies to all cases of death or injury to members of the armed forces occurring in the circumstances described in the section and where DHSS certifies that the relevant incident or circumstance is regarded as attributable to service. Available records do not allow us to determine the total numbers concerned since 1947.
