asked the Secretary of Stale for Transport whether he has any proposals to introduce legislation to amend section 40, subsections (11) to (13) of the Highways Act 1971 in relation to vehicle crossings over footways and verges so that a person would not have to pay in advance and would not have to use the highway authority for construction.

We have no proposals to amend these provisions which are now consolidated in section 184, subsections (11) to (13) of the Highways Act 1980. They enable any person to request the highway authority to construct a vehicle crossing. If the authority agrees to carry out the works and provides an acceptable quotation, it is right that the person should be obliged to pay in advance since the works are for the benefit for that person and not for ratepayers generally.
