§ Mr. David MitchellSince the United Kingdom became a member of the EC there have been changes in the system of pilotage in United Kingdom waters reflecting the provisions of the Merchant Shipping Act 1979 (now consolidated in the Pilotage Act 1983) and of 25 pilotage orders and 1,071 byelaws made under those Acts and the Pilotage Act 1913.
Pilotage matters within the member states of the EC have not been harmonized.
§ Mr. Muddasked the Secretary of State for Transport if he will list pilotage orders, indicating which have been made by him and which have been approved by him on., application by an interested party or by the Pilotage Commission, respectively.
§ 1982 Mr. David MitchellA list of the 175 pilotage orders is attached. The nine orders made since 1979 have been submitted for Parliamentary approval by the Secretary of State on the application of the piolotage authority for the district. None has been aplied for by the Pilotage Commission. The orders made before 1979 would have been either promoted by the Secretary of State or submitted on the application of the pilotage authority for the district, but comprehensive information is no longer available.

§ Mr. David MitchellThree members of the staff of my Department are engaged full-time on these duties; in addition this work forms a significant part of the duties of five others amounting to the equivalent of about two full-time staff.
§ Mr. Muddasked the Secretary of State for Transport if he will list the pilotage byelaws which have been rejected by him in each of the past five years.
§ Mr. David MitchellUnder section 15(3) of the Pilotage Act 1983, which consolidates earlier legislation, a byelaw shall not take effect unless it has been submitted to my right hon. Friend and confirmed by him with or without modifications. It is the normal practice, in accordance with section 15(4) to advertise draft byelaws and a substantial number of changes may be made by the Secretary of State in response to objections received; changes may be made, too, in order to render the draft byelaws intra vires the Act. No record is kept of the total number of such changes. But no byelaws have been rejected in total by my right hon. Friend within the past five years.
