HC Deb 29 July 1983 vol 46 c712W
Dr. Blackburn

asked the Secretary of State for the Environment if he is satisfied that the public have had adequate warning about the expiry of listed building consents issued before the Local Government, Planning and Land Act 1980 came into force.

Mr. Macfarlane

The Local Government, Planning and Land Act 1980 introduced time limits for listed building consent. As a result, the validity of some consents will lapse on 13 November 1983 unless work has started. Those affected are consents granted before 1 January 1978, unless a different date has been expressly prescribed in the notice of decision authorising the work.

Consents granted between 1 January 1978 and 30 November 1980 will lapse 5 years after the Local Government, Planning and Land Act 1980 came into force, that is on 13 November 1985. All those granted since that Act was passed have been subject to the statutory time limit of 5 years from date of issue unless a shorter or longer period is specified in the notice of decision.

Fresh applications for a further consent to the works may be made; it is hoped that this course will be followed, rather than precipitate action to execute the works before the consent lapses.
